Does a groundwater pumper have the right to cause sinking?

NO!  Although a groundwater pumper has a right to pump, it's subject to two restrictions:


  1. they can’t cause negligent subsidence
  2. they are subject to the regulations and restrictions of groundwater conservation districts


All residents, and especially our neighbors that are near drainage and streams, have a right to expect that their property will maintain its elevation and not be subject to future flooding from the reduced drainage capacity that comes with subsidence. Instead of over pumping and causing negligent subsidence, we believe we should use less groundwater and start using the surface water reservoirs that were built for that purpose.. 

Since we, the residents of Montgomery County have the most to lose by negligent groundwater pumping it is important that you let your elected Groundwater Conservation District board know that you want your property rights protected.
